A federal court ruled on Monday that Sergio Adrian Hernandez, who was shot and killed by a U.S. Border Patrol agent in June 2010, was protected by the U.S. Constitution even if he was on Mexican soil and his family can proceed with a civil lawsuit claiming $25 million, local media reported. Hernandez was killed when he and his friends briefly crossed into U.S. territory throwing rocks at border officials.
